People who have high enough IQ to be trainable and to not cause problems never got convicted because they probably never got caught. You have to give them food and ammo, and send them to do things, war is not Call of Duty where you drop into an arena and just need bodies to throw at the kill feed, they are expected to do tasks and people are relying on those tasks to be done, said tasks involve them being able to operate independently.
