Racism was first classified as a criminal offence in Brazil in 1951, with the enactment of the Afonso Arinos Act (Law No. 1,390/51), which classified it as a misdemeanour. However, its classification was tightened and defined as a non-bailable and imprescriptible offence in 1988, with the enactment of the Federal Constitution, and specifically regulated by Law No. 7,716/1989 (known as the Caó Law), which established penalties of imprisonment for one to three years and a fine.
