The NCAA kept its thumb up its ass for over half a century and once the Supreme Court pulled that thumb out and dry fucked them, all hell broke loose. University sports competition is clearly interstate commerce and Congress is who should be setting laws for this but they're all too scared to go on the record with anything that has the potential to make winning more difficult for teams in their state. Trump's executive order probably isn't constitutional, though it's possible it is through some derived power given the the Department of Education (which would be ironic since he wants to shut that department down).In a functional system, Congress would either set laws about this or create an agency with the power to regulate intercollegiate competition. Instead they futz around, waiting for the next campaign cycle to bring in the cash.
