Are there any agreements on how the moon will be distributed? Because now Elon is claiming SpaceX are shifting focus from Mars to now build a base and data center on the Moon.

By rights of being the first, by proxy, to visit parts of the Moon, he can claim ownership over wherever his rover has traveled. Ultimately, might makes right, and if some country wanted that lunar clay, he wouldn't be able to defend it. The Outer Space Treaty has no teeth and will be discarded as soon as it gets in the way. For now, it's an agreement to table the issue of ownership so there won't be a land rush that could result in conflict and poor allocation of resources.
