Because it's very difficult to actually lay out a concrete rule for when gerrymandering is happening vs when it isn't. Sure, we as humans can see when it looks like gerrymandering is happening based on weird border shapes, but it's very hard to nail down a technical definition for "this is gerrymandering" vs "this just matches a particular terrain element that we decided to use as a border / this matches the amount of towns that are part of the same community / etc".

And to make something illegal you have to have it not be subjective or vague.
