The issue isn't the gerrymander itself.
When Roe got overturned the VA Legislature changed amending the Constitution to prevent any future Republican majority from outlawing abortion in the Constitution.
One measure was requiring 51% approval in two Legislative sessions.
Fast forward to today.
In order to get the measure on this ballot they had to use a special session as the next legislative session would happen a year too late.
This is unconstitutional. They were very thorough in writing the Law as they thought the stakes were very high.

You will be able to tell the fix is in if this thing rockets through the State Judicial system.
They need time to come up with a reason to ignore any potential SC ruling against them.

This is an open and shut case. Only naked partisanship by the VA SC can save it. It is absolutely possible that happens.
If this rockets through you will know the fix is in. If they dilly dally the US SC could take it up and sit on it if it is to close to Nov.

A "special session" in this case is a reconveneing of the current Legislative Session for a specific purpose.
It is not its own Legislative session.

The writers of the Law in question wrote it so they had a year to apply pressure.

This year delay would prevent the redistricting measure from being on the ballot in time to take effect.

They simply ignored the Law they wrote.
This is not a complicated case. It is unconstitutional.

The Virginia Supreme Court will likely let the results stand because they let the election happen in the first place. The GOP argument is that because early voting started before the first passage of the amendment, there was no intervening General Assembly election between the two required passages of the amendment. There also would not have been 90 days between the second passage and the start of early voting as required. The pozzed court will likely say only election day matters for the timing despite a million voters casting their ballot before the first passage.
