HAHAHAHAHAHAHAHAHAHAHAHAHAHA>A Virginia circuit court judge on Wednesday struck down the state's voter-approved redistricting amendment in its entirety, ruling that the measure was unconstitutional from its inception and that every vote cast in Tuesday's special election — for or against — is legally void.https://meidasnews.com/news/virginia-judge-voids-redistricting-amendment-invalidates-all-votes-from-tuesdays-special-election

>>533718363>will of the people>51/49 vote>obama campaigned for it...Anyone suggesting this is fucking retarded. Admittedly, democrats DO a good job at these things, and campaigning and getting people out to vote. I would have serious questions as to how many republicans even knew the implications here. There's tons of people who mostly vote in major elections. They've got OBAMA .. and I heard the claim that 95% of the money involved in this is "anonymous". So you have democrats dumping BIG MONEY and having their top guy campaign to get people out to vote for this. And then with republicans, I doubt there was nearly the effort to get people to vote as democrats attempt to steal their seats. Also very interesting claim I heard yesterday about gerrymandering in general seems to be quite real...They create the districts in such a way that they "bleed into" dense population areas. By design... Because if they have 80% of the vote in that area, they're then able to take over other districts using the votes from an area in which there's a dense population and overflow of votes.I just looked at the texas map, and it really is like that... Many districts STRETCH INTO places like Houston, therefore allowing voters in houston to vote as though they were in districst that should be much further away from houston. It's fraud on a mass scale, and we should look at every state to see how bad this is.

>>533719425>Legal scholars of /pol/>Will higher level courts allow it or just make the same ruling as the circuit judge? Its not particularly clear. It will likely come down to the Virginia Supreme Court which is known to be fairly conservative, but im not an expert on the Virginia constitution. Supposedly during a Virginia special session only laws pertaining to the stated reason for the session (the budget in this case) can be put to referendum. If that is actually the case then VA Supreme Court will likely uphold the ruling and the re-districting would be illegal. Most states dont have this 'special session' rule, its really about Virginia state law here. The US Supreme Court is unlikely to take up this case based solely on timeline alone, but this SCOTUS has been pretty deferential when Election changes come from Legislatures by law or referendum.I would say that conservative judges like the one that struck this referendum down are generally not 'activist judges' that do retarded shit for political reasons. That is almost exclusively female/minority judges, that are literally making shit up, or rule against a law just because they can. This alone would lend credence to the idea that the referendum violated Virginia law. So if I had to bet I would bet that the new district map will NOT be implemented.
>>533721275>I would say that conservative judges like the one that struck this referendum down are generally not 'activist judges' that do retarded shit for political reasons. This, conservatives (tragically) are famous for simply laying down and taking it, unless the overreach is particularly egregious.

>>533722251"Fairness" is treating state elections to the national level and saying "well Ohio did this, so Virginia must do that to 'balance out' their change." It's an effort to disenfranchise people from one state because others from another state are disenfranchised and saying it's fair because two wrongs make a right.I think it's a bad precedent that any state or political party can just redraw district lines 7 months before an election. Yes, I know other states are actively doing it too, but anything that pushes back on this is inherently good. I'd rather see it go to SCOTUS and them knock it down nation-wide.
>>533722247Are you playing dumb or actually dumb?Texas redistricting on Trump's orders is what kicked off this gerrymandering arms race.It just make it more pathetic when cons turn around and whine about Dems beating them at their own game while actually putting it to a vote.>why do you think putting it to a vote gives it inherent legitimacy? You were the one whining about having a "mandate". >>533723038Lmao, you need to flail at a straw man because you can't address the actual facts.Democrats have tried multiple times to end gerrymandering across the country and Republicans have unanimously regected it.Republicans WANT to be able to gerrymander, at least when they do it. They just hypocritically get mad when Democrats beat them at their own game.As long as Republicans demand to be free to gerrymander Democrats allowing them to one-sidedly do it for some moral grandstanding will just ensure Republicans will rig things to the maximum so that no one else, even some hypothetical third party, can win even with a huge majority.Unfortunately it seems the only way gerrymandering will end is if Democrats out-gerrymander Republicans till they get enough control to institute a national ban without Republican help.
>>533727256Democrats try to end it when they feel it would benefit them to end it. They engage in it vigorously when they feel it benefits them to engage in it. There's no morality behind it, it's opportunism. The state of gerrymandering across the country broadly benefits the democrats. Texas didn't start any gerrymandering arms race. Gerrymandering has been happening for decades with flareups of increased activity here and there. You're a dumb fag who thinks that because you just noticed something, it's new.

>Wednesday's ruling was not Hurley's first attempt to stop the amendment. He issued similar rulings blocking the measure in January and again in February — and both times, the Virginia Supreme Court stepped in to allow the process to move forward while it considered the underlying legal questions.
>>533730698Obviously the argument is the Democrats of gerrymandered it the way they want and now they want to end gerrymandering so that no one can change it you fucking nigger.
the problem with gerry-mandering is that it frequently backfires. your party gets more seats temporarily, but then you lose the governors race, lose the presidents race, etc. it turns out, people don't like being blatantly disenfranchised, and they know when its happening. I think it should remain legal to gerry-mander. let whoever does it reap what they sow.
>>533718363They've been doing it against Trump and libtards never stopped to think what will happen if all the conservative judges retaliate.
>>533732428I know the origins of the name, that doesn't change the actual reality that only Dems support a national ban and Republicans opposed it. As long as that's the case of course Dems would be dumb to just let Republicans gerrymander one-sidedly.>>533732572>Obviously the argument is the Democrats of gerrymandered it the way they want and now they want to end gerrymandering so that no one can change it You absolute retard, do you think a national ban on gerrymandering means that districts, even gerrymandered ones, would be frozen in their current state and only new gerrymandered maps would be banned? And I suppose the gerrymandered ones would just have to change the law to never redistrict again(which wouldn't even work long-term because of shifts in populations)? When people, mainly Democrats, talk about a national ban on gerrymandering they mean redistricting being done by independent committees in a way to ensure all votes are equally weighted and banning maps that give any party an unfair advantage. You clearly don't even understand the topic.
>>533718269>circuit courthonestly irrelevant. all the other idiotic redistricting events had legal challenges as well. you guys are getting too penisy.

>>533734519>Ban maps that favor ANY party>Yeah but black people still vote, I don't actually care about fairness!
>>533734724a fair system would put city people in disctricts with other city people and country people in districts with other country people. non of these """fair""" proposals can stick to this one simple principle because their idea of fairness is inflicting niggers on as much of the map as possible.
>>533735239look chud they called it the "end gerrymandering bill" so that means it was intrinsically good but the evil republicans stopped them!
>>533718363>51% vote to take away the voice of the other 49%>"Welp you guys it is the will of the people so it must happen"This is why we are a republic not a democracy. Democracy is nothing more than mob rule and the "will of the people" most of the time is retarded and self-destructive hence why there needs to be checks on it. Funny how when a liberal judge strikes down stuff conservatives want it is okay but when liberals have their stuff stuck down it is unfair and "against the will of the people".
>>533718269Corrupt leftists pedophiles on suicide watch.
>>533718269If I had my way, I would DEMAND the redistricting so that ALL of them are mandated to have both parties split down the middle, even if it means weird borders.
