Colton Scott Johansen is a former Ogden school resource officer in Utah. After a student came forward he admitted to raping minors as far back as 1994. He led police to two discs of CP at his home. Why can't all states just adopt a sentencing grid?

On one axis, you have the seriousness of the crime. Different crimes are associated with different scores here, with the highest seriousness being murder 1. On the other axis, you have the offender score. An offender with no prior convictions has a low score. An offender with more prior convictions or who is committing multiple crimes gets a higher score. You calculate the highest seriousness among all crimes committed, and an offender score based on the criminal history, and you get a range within which the sentence must fall. Pic related is Washington State's sentencing grid. If he had sex with a minor and created CP from it, then he'd at least be committing "sexual exploitation of a minor", which is serious level IX, which would give 31-41 months, for an average of 36 (3 years). This assuming no prior convictions. If the minor was particularly young, the seriousness level could go to XI or XII, increasing the average sentence to 7.5 or 9 years (once again, assuming no prior convictions). Even if he were in mere possession of CP, which he did not produce (seriousness level IV), and he had no priors, the sentence would fall in the range of 3-9 months (90 - 270 days, average 180 days). A 30 day sentence would not be acceptable within the sentencing grid.

We already do this in every state for drug crimes. We have mandatory minimums and three strike laws that force people into prisons for possession, we just don’t extend that to any of the violent crimes.

There's actually plenty of functional drug addicts out there. Sure, many of the homeless folk aren't functional, but for others, it becomes one of the many reasons you simply never quit a crappy job. The paycheck ultimately becomes the means to feed the addiction. Also, someone who is traumatized too greatly may end up dropping out of society, becoming a drug user themselves, or potentially becoming a criminal themselves. A lot of people want to just chock up mental health as something that's fake and gay, but it's pretty damn important when you look at the bigger picture.

Modern society is full of people who are afraid to rock the boat. We have made consequences extreme and consistent for anyone who is not part of the in-group that is permitted to commit crimes. Ideally, we would have a consistent system where there is no in-group, and we could put politicians and billionaires in the slammer alongside the man who robs a gas station on meth. We don't get that, because the in-group runs the whole system, so they won't permit it to be used against themselves. But they do apply it quite hard against common folk who think they can run the system themselves. Did you create justice that was not permitted? Justice is brought against you. When someone gets a murder 1 charge, the question was not asked, "did this murder make the world a better place?" Instead, the question is asked, "was someone killed, and was it intentional/planned?" If yes to both, life in prison, no further evaluation.
