The rules regarding what you can and cannot build around a public road are byzantine and changing, they can fall under a dozen overlapping jurisdictions. That particular rule gets broken all the time by big corporations. The inspector rings your doorbell, tells you about it, if in 15 days you haven't done anything about it they might warn you again or start filing paperwork. Maybe the road engineer in charge of that area had a bone to pick with them there's more to this story, more likely than not they were stubborn/retarded.
