Their guidelines, conveniently published in 2020 just before this all went nuts, are based solely on limiting thermal effects: keeping your skull from a slow boil. A meticulous report on the topic highlighted a few minor shortcomings with this logic:

illinois turns away from the constitution on firearms.
missouri turns away from federal enforcement of red flag laws.
california goes past regulations to implement stricter regulations.
minnesota and ohio both institutionalize medicaid fraud.
maine and texas allow gerrymandering but virginia got slapped down by its own supreme court.
virginia five years ago tried to ban "assault weapons" but basically every sheriff in the state refused to enforce it.
hawaii has customs enforcement for anything inbound to hawaii even for other USA states.

the government already has mass surveillance. and they've had it for decades.

during COVID, the greatest government-orchestrated attack on its citizenry in living memory was conducted. and yet the only enforcement mechanism the american government had was tightening the screws on businesses (and government buildings), so that businesses would privately enforce the attack. which not only was rare country-wide (most states did not implement any social regulation, it was specific municipalities), businesses also were understandably slack on enforcement. the most unilateral and cohesive attack on the citizenry barely mustered wearing a mask, in some states, in fewer cities. and their OSHA-based vax mandate was directly shot down (pun intended) in SCOTUS.

if we wanted to protest mass surveillance we should've done it decades ago. but we didn't and we are in a dragnet. this is fully understood. but there's nothing the government can do besides monitor. this was proven during COVID. if you want to race to the bottom about technology existing, go ahead, i'll join you. but i'm not scared of spooks. and if things got bad enough, people would vote to change the policy. that's why states have been increasingly adopting "constitutional carry" for the past decade, people vote and things move the direction people want.
