He's a dyed in the wool institutionalist who will rule however he thinks will prevent the sullying of the institution of SCOTUS. I'd take a clone of Kagan over Roberts any day of the week. She's at least motivated in part by the legal question at hand. Roberts only gets to the merits if he's sure ruling in one direction will not have any negative implications for the reputation of the court, and any case worth bringing is going to have potential reputational implications from SOME group. So the result is in 99% of cases he never gets past the reputational harm to the court stage of analysis.
