The initial aggressor cannot claim self-defense unless they have disengaged or otherwise articulated they have given up. Only then can they use self-defense (of proportionate force). If you are getting the ever-living shit beaten out of you, shooting the person beating you is arguably proportionate force. I don't think he did any of the pre-requisite surrendering, though.The problem is, was he the initial aggressor, and I don't think what he said even constituted as disturbing the peace, even in a blue state, which doesn't matter because he was in a red. I don't think there was legal justification for the man he shot to attack him, nor do I believe he was using proportionate force against any perceived assault, by beating the crap out of him. The issue is, does provoking him by egging him on, by legal means, make him the initial aggressor? That's going to be a hard no.Put all emotions aside.
