Now that capitol police are suing Trump for the J6 riots, would it be legal for them to sue Nick Fuentes for inciting it? How come Nick Fuentes and that Ray Epps guy didn't face any repercussions despite goading people into the riots?

The primary failures of J6 can all be traced back to capitol police, and democrats who didn't want national guard there as Trump had authorized. They were ok having them there sleeping in parking garages to protect biden's inauguration, but not to prevent the J6 false flag democrats plotted.
