Once a cop takes someone into custody in America they have a certain duty of care, and the state alleged Derek did not meet this having been clearly informed of his medical emergency. We also have case law surrounding this exact scenario having happened before, criminals with lots of drugs on them take all the drugs when they see they're about to be arrested, and die of a OD in police custody, then the cops get in trouble for not getting them medical attention quick enough.
