I think the main problem is we mostly see footage from behind the vehicle, so it's not clear what the distance is between him and the vehicle. If it is a foot and a half you would have to be a retard to say "she wasn't going to hit him and he knew that". But if your only perspective makes it seem like the guy in front of her vehicle and the guy beside it are an equal distance away you're not going to really know how much risk he was in
