It's a strange situation because Pepsi obvious never expected anyone to try to claim the warplane. At the same time, there was nothing in the context of the ad to indicate that it was meant as a joke. Pepsi should have set the Pepsi Point amount to be high enough to cover their costs to obtain such an aircraft. My guess is someone in the ad department didn't even bother to check on the value and just assumed their extremely high Pepsi Point requirement was enough to keep anyone from trying for it.
Not sure I really agree with the court that the guy who tried to redeem the points for the jet should have known it was meant as a joke. Nothing in the context it was presented indicates that. Also the fact that Pepsi wasn't shy about letting people know they used Soviet warships as part of their dealings with the Soviet Union could be considered a setting of context.
Overall, I think the judge knew Pepsi fucked up and simply wanted to give them a way out.

I actually looked into this and the follow up. The girl actually took legal action and the people running the promotion caved in. They took her to a Toyota vehicle dealership and told her to pick whatever Toyota she wanted. All for her to drop the legal proceedings.

1. The Harrier was still being used by the military in the 1990s. So there are plenty of older civilian jets they could have given him.

2. As a show of good faith, they could have given him a cash reward instead. Pepsi spent more money on lawyers fighting this case than it would have cost to just pay him off.
