They'll just put a lien on your home or hit you with a breach of contract, since HOAs are a contract between the homeowners and the developer. This could lead to you being unable to sell or refinance, or could potentially lead to foreclosure.

Because the idea is that the subdivision has a collective responsibility to maintain property values for everyone in the neighborhood, for their own benefit and the developers.

HOAs exist because plenty of people have horror stories about shitty neighbors being a nuisance or lowering property values in the neighborhood through neglect.

You have to choose between neighbors that do weird/irritating things, or a tyrannical bureaucracy that has you by the balls and can fine you for any retarded reason.

Reminder that no state has more homes in HOAs than not in HOAs. If you live in an HOA, you freely made the choice to live in one.
Reminder that if you claim you were "forced" into an HOA, you're a liar. You saw a house you liked that was part of an HOA, bought it, and then got angry about your choice. No anon has ever been able to show even one instance of a non-HOA property being forced into a HOA against the will of the owner of the property. It has never happened. Not even once.
Reminder if there's only one house on the planet you can afford, near the only one job on the planet you are capable of working, and that "forces" you into buying a property in an HOA, you're either a pathological liar or one biggest loser to ever exist.
The simple solution to HOAs: don't live in one. You might have to deal with a neighbor whose mailbox looks like a cow or someone down the street who painted their gutters purple. If you don't want to deal with an HOA your only option is to purchase a home in a neighborhood that doesn't have one. If you put in a contract on a home in an HOA community you'll be provided a disclosure form telling you as much. Making sure the HOA dues are current and paying to pull the HOA documents is part of the transaction. If you purchase the home anyway but refuse to follow their rules or pay the HOA dues then they'll fine you and send you violation notices. If you continue to ignore them then eventually the HOA can foreclosure on your home. However it would take years of willfully pissing them off, committing HOA violations and not paying dues for it to get to that point.

Suburbia doesn't need shared spaces because everyone has their own bit of space. If you want others there, invite them. If you don't, you're not forced to be around strangers. The other anon did a good enough job of explaining it, but I'll provide a further explanation as well. The HOA is a governing covenant established by the builder and residents. It carries the same force of law as any other contract or legal document. Every home in the HOA is subject to these rules and anyone who purchases one of the homes must agree to them. Again, for any home located in an HOA you'll get an HOA disclosure. If you put in an offer you'll get the HOA documents themselves. When you close on the property the title company will make you sign a document saying "This home is located in an HOA and is therefore subject to their rules." if you refuse to sign it, then you can't close. Simple as that. Once you've bought it, you've agreed to the terms. Once you own a home in an HOA you can no more "opt out" of being in it than you could "opt out" of being subject to the various laws and ordinances of your local city. The very concept is a non-sequitur. By consenting to live there you are explicitly bound by them.
