Good question. Discussions on this always seem so contradictory.
Preface: I'm obviously not a lawyer.
From what I understand, the 'loophole' for making a biopic about someone alive without their blessing is to adapt the life-rights of someone else in their circle, or adapt a factual non-fiction book and stick to the literal facts. So like The Social Network was based on a book where Saverin consulted on it. It's also heavily based on literal transcripts from the court cases and depositions.
The Wolf of Wall Street was based on Belfort's memoir, and they changed the names of pretty much everyone else to avoid potential defamation lawsuits.
So with this, I'm guessing that there's either a book that this heavily leans on. Or they have people who worked on the show acting as consultants, along with a trove of recordings from the time period that gives them a defence against any lawsuits with 'we have proof this happened though'.
