I could swear it wasn't even possible to patent a way to do things. How is letting enemies remember encounters and advance considered an intellectual property? It is such an intuitive way to design enemy encounters. You wouldn't be able to patent this in Europe or Japan. Why are Americans like this?

So far Warner hasn't sued anyone that created systems analogous to the nemesis system.In general this means no one can make a very low effort 1:1 copy of what Warner did, but nothing stops them from doing it their own way. The reason why almost no one does this is because they don't want to and they don't think it's that good of an idea.

The game is fucking piss easy, so any competent player never had a chance to actually interact with the nemesis system, as facing your enemy in future encounters would require you to lose or run away (and any that won the dice roll to survive/didn't get the decapitation finisher were wiped out quickly in the next encounter anyways)
