Since they technically dropped it on Steam a month or so before they shut everything down, they're gonna say that they satisfied the kickstarter stipulation and don't have to refund the money. Since Steam froze the funds, you can make the argument it was falsely released early to make sure they didn't have to refund people and they knew it was an incomplete game that was imminently gonna get shut down
