golly maybe when a game trailer is released showing not-pokemon being caught in balls, you shouldn't wait 2.5 years and only act when said game releases and sells gangbusters, looking way better compared to your last couple early>gen-6 looking piles of shit

If this had actually happened Nintendo could successfully sue the USPTO for discrimination and unfair enforcement so yeah be happy you faked it.

I'm a nintendofag but I still think they should be shut down on all of their patent troll bullshit, also revoke the nemesis system patent faggots

No, no it isn't.

>>
>>736161272
That would be America. It's why patent trolling can only happen there.
>>
>>736160540

It's real, and you can't patent mechanics that have been around since the 19 fucking 80's. You can't patent shooting or jumping either. those are all just things you do in games.

It's actually insane how dumb people are
>>
>>736158362
As always vidya journos lie (or have no idea what they are talking about, dunno which is worse) and retards on /v/ fall for it
>Less than two months later, the head of the United States Patent and Trademark Office (USPTO), Director John A. Squires, ordered an ex parte reexamination (EPR)
>Nintendo let the deadline for a response slip. The examiner therefore started the reexamination process and put out a non-final Office action last week, rejecting all claims of the patent in question
>As mentioned above, the rejection is non-final (and even when such rejections are labeled as “final”, the process is far from over, given that there can be, at minimum, an appeal to the Federal Circuit).
>rejection in this case means “declaring ripe for revocation”
>Nintendo has two months to respond, but that period can be extended if Nintendo asks for it (and Nintendo doesn’t even have to state a reason).
>By not looking at real-world games, the USPTO is making this somewhat complicated. For 18 of the 26 patent claims, they have to combine two different prior art references to argue that the claimed inventions are obvious, and for the remaining 8 patent claims they even have to combine three to get there.

>>
>>736158362

>>
>>736162096
>It's real
Then they have grounds to sue the USPTO for unfair discrimination since they've revoked a patent for no real reason since it's an original mechanic not present in any other games.
>and you can't patent mechanics that have been around since the 19 fucking 80's.
True but that's not what this about. We're talking about a mechanic that's only present in their one single game so far.
You're mistaking this with the idea of summoning as a concept, an easy mistake to make for the intellectually challenged but not one that people with more than one braincell can make.
To make it simple to understand it's how it's done, not what it is like a coin made of bronze vs one made of gold, both are conceptually coins but are made out of different materials, heated at different temperatures etc
> You can't patent shooting or jumping either.
Yes, you can in fact patent them if they're novel executions of the concept. For example if Nintendo had patented jumping in Mario it wouldn't have stopped jumping in Sonic because they have different functions like Mario only being able to damage enemies by landing on them from a jump while sonic damages them regardless.
>those are all just things you do in games.
Yes, conceptually, not mechanically.
>>736162347
>>By not looking at real-world games,
They didn't even look at other games?
And people wonder why the USPTO is seen as the single most incompetent Patent Office in the world.

Summoning monsters to battle enemies has been done before, if that's not what they're patenting then how can they use it in their lawsuit against a game that summons monsters to battle things? Why don't you explain how the patent is different from something like World of Warcraft pets instead of some irrelevant metal analogy, they basically function exactly the same as the patent describes and they're from 2004.
>>
>>736163070
>Summoning monsters to battle enemies has been done before
>Why don't you explain how the patent is different from something like World of Warcraft pets instead of some irrelevant metal analogy, they basically function exactly the same as the patent describes and they're from 2004.
The whole explanation is right here.

>To make it simple to understand it's how it's done, not what it is like a coin made of bronze vs one made of gold, both are conceptually coins but are made out of different materials, heated at different temperatures etc

In other words, unless you can find a game prior that plays EXACTLY THE SAME, not close, not conceptually but EXACTLY THE SAME DOWN TO THE AMOUNT OF BUTTONS USED TO EXECUTE THE ACTION, it's considered new.
>>
>>736163070
>instead of some irrelevant metal analogy,
His analogy works though, wow doesn't work like a pokemon game at all. Having a player character launch a physics based object to do summon isn't how it works in wow nor can you throw an object at another object to instantly have your summon react specifically to the object it was thrown at.
Same thing conceptually, but different function

>>
>>736165140
You're literally doing it right now. The two anons you're replying to aren't defending Nintendo, they're explaining patents.
You on the other hand are angry that Nintendo is suing over patents due and as such you're currently defending Pocketpair.
>>
>>736165159
David and Goliath isn't a story about a man overcoming adversity, it's a story about a man cheating in a test of skill by using a long range projectile weapon because he was a cowardly jew.
>>
>>736162650
>You're mistaking this with the idea of summoning as a concept
I'm confused about this as well, anyone have link to what Nintendo originally filed a lawsuit?
>>
>>736165338
>No those anons arent defending Nintendo!
>They're explaining how Nintendo hasnt lost yet! Nintendo cna still win this patent war that they started in 10 more years!
>But you're the one defending corporations! You're currently defending Pocketpair!
Never mentioned nintendo or pocketpair even once in my posts lmfao. Your silly tantrums are so adorable
>>
>>736165231
I'm not aware of any homing but if that's all it takes to invalidate the patent then you might as well say that Palworld doesn't violate it because similar minute details like the aggro rage being different, the time it takes for the creature to emerge is slightly different or the throwable travels at a different speed. If there is zero room for deviation in a patent dispute then it's barely even possible to violate it.
>>
>>736165737
See what I mean, you're seeing it as them caring about whether Nintendo wins or loses purely because it doesn't paint them as down and out. In real it their statements are neutral m
>>
>>736158362
April Fools aside, game mechanics should not be allowed to be patented. Nemesis system shit is an example of this.
>>
>>736165863
>because similar minute details like the aggro rage being different, the time it takes for the creature to emerge is slightly different or the throwable travels at a different speed
The first two don't pertain to the thrown object and the last is superficial.
It's all function anon.
>>
>>736165920
>No they're not tendies! You seeing them that way makes you the corporate cultist!
Lmfao you're so salty you cant even type straight. Go take a walk before you pop a blood vessel, lolcow
>>
>>736166010
>Nemesis system shit is an example of this.
Not really, people don't use it because it was patented, they don't use it because it doesn't add anything. Even then we've seen indie games use it before
>>
>>736165593
In this case the "skill" is the amount of money and lawyers they have, Palworld will have to resort to facts and logic to win.
>>
>>736158362
someone post the tendie seethe on reddit/twitter, i need that.
>>
>Tendies have to argue the patent for summoning monsters for battle is 100% original do-not-steal idea only found in pokemon
>But they also have to argue that palworld stole it somehow
>>
>>736166010
patent trolling is a thing and will always be a thing until retards decide that holding onto a piece of paper and doing NOTHING at all with it for DECADES while constantly hounding everyone who does anything similar so they can sue them into compliance

these people sit on patents and do nothing with them aside from trying to sue anyone they can
they will never attempt to sell their idea to investors, they will never order parts from warehouses to make their patent, they will never accept deals to sell their patent, they will never ship their patent to customers, because they have none
they LITERALLY only exist by suing targets that fall under their vague description of something that is widely used
>>
>>736166217
>Palworld will have to resort to facts and logic to win.
Is that why they tried to lie and throw modders under the bus?
That said, David is a good example given the atrocities he committed as king.
>>
>>736160540
the concept of capturing and training beasts/animals in order for them to perform tasks for you is as old as mankind itself, stone age savages were domesticating wolves and wildcats to serve their needs, Nintendo patenting that concept is literally as crazy as them trying to patent fishing in a videogame, hell, taming wild beasts likely predates the concept of fishing too.
>>
>>736166351
Fun fact, patent trolling only happens in America due to the incompetence of the USPTO and legal system there.
Every other country has eliminated patent trolling by doing their actual job.
>>
>>736158362
Let the era of good Pokemon clones begin.
>>
>>736166407
>the concept
It's not about concept. Capturing an animal with bait and rope and then domesticating and breeding it until you get the desired result isn't the same as throwing a ball despite both having the same end result
