>revokes
Retarded journo, retarded OP repeating what retarded journo spews out.
>Less than two months later, the head of the United States Patent and Trademark Office (USPTO), Director John A. Squires, ordered an ex parte reexamination (EPR)
>Nintendo let the deadline for a response slip. The examiner therefore started the reexamination process and put out a non-final Office action last week, rejecting all claims of the patent in question
>As mentioned above, the rejection is non-final (and even when such rejections are labeled as “final”, the process is far from over, given that there can be, at minimum, an appeal to the Federal Circuit).
>rejection in this case means “declaring ripe for revocation”, not that the patent is actually rejected
>Nintendo has two months to respond, but that period can be extended if Nintendo asks for it (and Nintendo doesn’t even have to state a reason).
>By not looking at real-world games, the USPTO is making this somewhat complicated. For 18 of the 26 patent claims, they have to combine two different prior art references to argue that the claimed inventions are obvious, and for the remaining 8 patent claims they even have to combine three to get there.
>>736259551
You are dumb. Patents describe a way to apply the mechanic in a video game. It has nothing to do with fucking stories from centuries ago.
This is the level of understanding /v/ has, fucking he’ll.
>>
Iirc this was rejected on non final basis because the wording is too similar to Nintendo’s other approved patents that cover similar things
>>
This is just blatant anti-Japanese sabotage on America's part. There is nothing wrong with the patent at all, they just don't want Japanese companies to do well.

>>
>>736270316
>IT HAS TO BE AN OBJECT THAT YOU THROW AT THEM TO CAPTURE THE
that sounds so basic as fuck though, that's like patenting the idea of nets and then acting like you did some complicated thing to come up with that idea.

You only think it's basic because Pokemon normalized it
>>
>>736272497
>cave man throws rock at creature and knocks it

seriously how is this unique mechanic there's a bunch game where you throw something at a creature, which are essentially just a pokeball but with extra steps or in this case a different animation
>>
>>736272645
You're grasping dude.
>>
>>736272645

and i know but the fact that you can patent the idea of capturing a creature with the most basic 's of fundamentals is dumb

It's amazing how much palworld discourse is just them pretending not to understand things
>>
>>736273459
ignores the fact that he didn't mention what the patent says after throwing something at something, it's almost like he left that out to try and ignore the point i was making
>>
>>736273431
Sure I'll waste my time explaining common sense understanding to you, since your entire goal is trolling me anyway.

The patent in question isn't about throwing things at animals. Also using pokeballs to capture and summon creatures is not at all immitative of ancient man throwing rocks at creatures to kill them. Nor is the rng chance of capturing due to your throwing accuracy in nearly every pokemon game.

Your analogy is fucking gay and reductionist. If you have a problem with the patent in question read it and understand it first, and then get back to me.

Hope this helps.
>>
>>736273643
oh sorry I meant *Creatures considering the guy said you throw something, and then nothing else.

>a pokeball is some sort of invention made by humankind despite Not really going on details besides pokemon lets them in hoopla and shit on how they manage to digitize a pokemon into a small ball which is essentially just a net.

so, you're telling me that pokeballs are on the same levels of fundamentals as a gun which was essentially just gunpowder go boom and object goes flying out of it, difference is that a "gun" has objectively progressed through years with barreling and new way to fire something now they are coming up with magnets being able to fire objects out of thing and oxidization or how you say that word, but pokeballs are just a mcguffin that work because you throw them at a creature and they get captured and nothing really explains how, there's nothing that makes them unique beside having for specific situations like nets.
>>
>>736259084
HAHAHAHAHAHAHAHAHAHAHA
>>
>>736273953
Read the patent.
>>
>>736273953
>Your analogy is fucking gay and reductionist

same guy but to add on to this it's not really far off to what analogy i used for cave man, cause back then during the stone age and any primitive age, caveman and tribes used to weaken creature before knocking a creature out with either a rock or some sort of dart then sometimes net them up, the fact that you thought that was dumb shows u never really studied history, they even had "pokemon battles" when man tamed the wolf which was used to either weaken animals or stir them into areas where they can either spear or stone them to death.

the fact you called that reactionist quote is generally retarded considering you think the pokeball is some sort of innovative discovery when its only carried by its fictional setting which doesn't really make sense at all like almost all of hero comics, the pokeball still follows the same mirrored fundamentals as a realistic setting basically weaken the animal then net it or knock it out, but in this case it just captures it without no problem

>read the patent i have which i asks the question why you're dodging the question on how the pokeball is somehow unique enough to be complicated, despite it being just a toss and capture and then release
>>

>missed the point award
>>
>>736275014
No I saw your point quite clearly, and dismissed it.
>>
>>736274985
Also wasn't like 26 of the patent all rejected by the uspto and nintendos excuse was they were being uncooperative despite not having an actual unique patent? so you really don't know yourself, bet you don't even know it was struck down because there were 4 patents detailing the same thing said in those 26 patents which shows you, yourself did not even read it so stop armchair lawyering AND actually do research before acting like you know everything about patents cause someone with a somewhat understanding would understand that's a red flag if u manage to apply a patent despite having the same formatting as another patent .
>>
Patents should be dismissed if they're too similar to another set of mechanics that have already been done, throwing an object to spawn a creature has been done plenty of times before the patent was created. Craftopia had almost the exact same set of mechanics years before, that should be enough to get the patent thrown out.
>>
>>736275723
What annoys me is they created these patents to shut down a game journos declared a clone with very little in common with Pokémon while hosting literal mechanical Pokémon clones on their own consoles for years
>>
>>736275835
This but every nintendo fags excuse is *BUTS OTHER GAMES* when those games are nowhere even similar and digimon was way older than it, before it started throwing patents around willynilly, it's more of a brand risk so it keeps its costumers on a leash to continuously buy they're products, if it really was about caring about they're artist they would've sent Pickmon a dmca which was actually a "game" had more of an actual backbone to be sued than palworld, neither will they even apologize for allowing ai shit like palland to slide despite sueing the company with the same name as that game
>>
>>736275470
>Also wasn't like 26 of the patent all rejected by the uspto and nintendos excuse was they were being uncooperative despite not having an actual unique patent?
Are you asking me? I looked it up and one patent that has 26 steps was rejected and needed further review by Nintendo
>in those 26 patents which shows you, yourself did not even read it so stop armchair lawyering AND actually do research before acting like you know everything about patents
It's not 26 patents, it's one patent with 26 steps. Do your research before replying.
>>
>>736276190
still 26 patents also it doesn't really matter what it's called so don't be disingenuous now when trying to talk about, And it's not a step patent or whatever the fuck you got that from, it called a 2-mode patent you dumbass and honestly stop acting like some lawyer and it's also suspicious that you didn't reply to me after a few hours of seeing that almost like you just went to actual do your own research just now, which tells me no you didn't know until now.

>And it's not a step patent or whatever the fuck you got that from, it called a 2-mode patent you dumbass
There's no such thing as a 2 mode patent. The patent in question was about a summoning a character and letting it fight in 1 or 2 modes.
>>
>>736276921
>2 mode patent
it's the nickname for it because it's one patent with 26 claims not steps, your really consistent on calling it steps and i know it can be reviewed, but honestly im more angry by the fact that there's no limit to how many times you can get it reviewed. for the main fact it can be abused by bigger companies against other companies making it into a stall battle or until they manage to get it applied making impossible for the recieving end to either fight until they run out of money or until they yield or until the offending end finally applies it and only way the recieving end can win is if the offending concedes.
>>
>>736259084
Hopefully this isn't just a one off and more will be done about the absolute fucking state of patents.
>>
>>736277343
That is typically how patent lawsuits go. If one gets rejected, then similar patents from the proposer are scrutinized further. It's a method used to punish patent trolling. Like if someone was caught lying about something then everything else they said is brought into question.
>>
>>736277427
GOOD, I hope nintendo learns something from this and starts playing fair.
