Emulation is completely legal and the entire process for obtaining files is completely beyond the scope of copyright law which is why it's a separate arbitrary felony under criminal law, rather than civil law which copyright offenses are in a way that's so poorly written that legally any time you use any sort of digital media whatsoever you incur a 4 year felony charge and technically the law itself is unconstitutional since necessarily to enforce it you'd have to violate the 4th 5th 6th 7th 8th 9th and 10th amendments.
