>Fortnite’s officially licensed Italian brainrot skin launch has sparked pushback from creators concerned over IP ownership on the platform.
>On April 1, Fortnite released a set of in-game skins based on the meme characters Tung Tung Tung Sahur and Ballerina Cappuccina. The launch raised the hackles of some creators who are already using so-called “Italian brainrot” characters like Tung Tung Tung Sahur in their Fortnite or Roblox experiences.
>The crux of the controversy is a debate over who is able to own and extract revenue from AI-generated memes. The company Mementum Labs has claimed legal ownership of Tung Tung Tung Sahur, licensing the character from its original creator, the Indonesian TikToker Noxa, and working with Epic Games to launch the character’s in-game skin earlier this month. However, Tung Tung Tung Sahur is a popular internet meme that was already present inside many creators’ virtual worlds prior to Mementum’s claim, muddying the waters over who exactly deserves credit for the character.
>>
>>737380226
>Epic Games’ acknowledgment of Mementum Labs’ IP ownership claim is the latest complication in an ongoing legal dispute over AI-generated memes. In November 2025, Spyder Games — a company owned by Roblox creator SpyderSammy, the chief product officer of DoBig Studios, which owns the popular Roblox experience Steal a Brainrot — filed a legal complaint against Mementum Lab claiming Mementum did not have the right to claim ownership of Tung Tung Tung Sahur and other AI-generated brainrot characters. The lawsuit is currently in process, but Spyder Games is confident in its argument because U.S. courts have not yet ruled in favor of any creator’s ownership of content created using large-language models or other generative-AI tools.
>“The Italian Brainrot characters that we’re talking about here have all come out of AI image generators, and the copyright office has been very clear and very consistent in its guidance, which is that if something is generated by AI without sufficient human authorship, it’s not copyrightable — and no court has disagreed with that,” said Aaron Moss, a lawyer representing Spyder Games in the lawsuit, in an interview with GamesBeat.
TLDR:

Mementum says they bought the rights to AI generated meme characters from their creators and you have to pay for their use.
Steal a Brainrot Roblox guys says no one owns the rights to AI generated characters and they're free to use.

The companies themselves operate on a post intellectual property logic. I hope to see an end to ownership of my ideas, the Chinese never gave a shit anyway and they're going to be running the planet soon. Your market share shouldn't be you were the first to make the thing, it should be you're the best/cheapest or fastest at making the thing.
>>
>>737380237
>which is that if something is generated by AI without sufficient human authorship, it’s not copyrightable
No court has said that, though. Courts said that the AI had to be used by a person and that is factually copyrightable. The case where courts ruled against it was an AI self-generating without control.

Precedent determines the extreme majority of law. Courts are focused on maintaining the status quo. Just like how most states have a law saying that if you'd been taking care of property for a decade, then someone can't come and take it with a survey or deed as it is effectively yours now.

The strongest case you can make in court is
>It already works exactly as we say and thus this is correct
>>
>>737381358
>people used to laugh at rare pepes
>>
>>737380487
>was already present inside many creator's virtual world
That's referring to the fact that the character was already widespread when a company bought the rights, the TikToker's video could still be the origin
Reminds me of that time the guy who (allegedly) drew Trollface tried to copyright it
>>
If AI kills jewpyright law then one good thing will have come out of it.
>>
>>737381478
is one company being scammed by another with fake ownership claims really gonna set legal precedent?
>>
I saw a youtuber talking about this shit last week. he asked a lawyer and while AI has no right to be legal. it was all under some trademark bs that should not work. You can literally take an AI character and make it into a brand logo so you can start suing people. even if you didn't generate the image or created shit.

Is just an issue of the legal system and there's way too many scammers doing it at the moment,

I was all for the death of the concept after the abuse I've seen, but I have concerns about slop flooding the industry thanks to AI. Like, on Youtube I have hundreds of channels blacklisted because all of them are just AI voices reading HFY stories about fictional space settings where Humans are notably different/superior to aliens, set to AI generated images and thumbnails, where the stories are either copied from Reddit posts or AI generated.

I understand but think this is a separate concern.
It should be legal to create and distribute that stuff, but platforms like YouTube have the right to disallow it arbitrarily.

In this specific case YouTube doesn't because it makes them more money from actual retarded babies and auto play.
But if they did care and think it was a problem they could remove and prevent it in their ToS, not above them at the legal copyright level.

Sharing an anecdote, I participate in a lot of livestreams and if they need to be edited for even a second of copyright the entire chat gets deleted.
This really frustrated me since that's basically my own personal history of messages being erased. Like someone ripping photos out of your home album. Gross.

It's being proven every day that kids who are growing up on shortform video can't follow complex storylines. They don't develop empathy from watching fictional characters strugle or be hurt. There's no money in it and the weapons of internet warfare have vastly surpassed the common man's capability to defend against them without corporate backing. Even worse, the average user doesn't hate the algorithms even if they think they do. Content that isn't custom tailored to their own comfortable circle is practically invisible to them which is why you see them "complain" about the algorithm, but actually they just mean the content they were shown at the exact moment they're complaining wasn't what they wanted.

Ragefaces were appropriated by the rest of the internet when the normals started pouring in heaps, and they used them like clueless grandmas who didnt know what an internet was, so they quickly turned lame and cringe.

Wojaks have come in a much more lived in internet population, so their use outside of these parts is not that dofferent to begin with anymore. Theres also the fact that wojaks have a melancholic baseline that just holds intergenerationally much better. And well, ragecomics became absolutely horrid and insincere.

Nobody owns AI generated content.

However, legally speaking, if somebody DOES manage to somehow own the rights to Tung Tung Whatever, Epic can plead the innocent infringer defense. After all, they licensed the character from a company which claimed ownership of the IP, and claimed to get that licensing from the person who "made" the IP. Thus, if it turns out that somebody else can make a claim over owning the IP instead, Epic can just state that they had (in good faith) attempted to license it from the original source. And if nobody can hold the license, then they're giving a minor amount of money to some random person in exchange to avoid getting their asshairs sued off if somebody wants to be upset about the whole thing.

Basically, Epic probably doesn't care who owns the IP, if anybody. They just care they have a legal defense if things go south. It's a CYA sort of defense, not a stance on AI IP rights.
>>
>>737382470
There's more nuance than just that. Unironic rage comics became dull and smuggies were used instead. Many people still posted rage comics for a while.
For wojak and pepe, there was an attempt to take them back by pushing out poopoopeepee memes and making them associated with the far right.
Later on, after the kekistan thing, people moved away from standard pepe to apustaja, tuxedo pepe, gigachad and variantjaks, which were less mainstream at the time.
Common pepe was seen as acceptable once again as the others became mainstream.

Culture just changes, look at it from further back rather than just over a 15-20 period.

Core /v/ or 4chan perhaps are of a particular age too, so the memes reflect our age and younger people are more fluid while older people are more rigid and unchanging.

AIfags always leave AI footprints behind because they have no real experience in what they're actually doing.
>>
>>737399456
Some AI companies that want to brand themselves as more "legit" and less harmful have started to push that, but it's not an inherent part of the process so there's always models and programs that leave out that step.
Even "showing your work" keeps getting harder because AI is increasingly able to simulate showing its work. You just gotta have experience with feeling out what is and isn't slop. Eventually we'll just lose the ability to tell if something is human slop or AI slop.

Most legal experts are taking the position that anything ai generated cannot be copyrighted, however, what if i draw my own character first and then have ai recreate it? Do i own that image?

What if i have ai draw mario or spongebob is that public domain?

If i write my own lyrics, can i copyright those even if an ai makes a song of it?

If an ai recreates a video game with one of pokemons "patented" gameplay ideas, is that an infringement?

Can i recreate MJ THRILLER using ai? Legal experts will need to settle this debate before ai completely conquers the arts in the 2040s and permanently replaves all artists and religions for ever and ever. Lol.

All of this is already settled. You own the character you create but cannot copyright the specific pictures made of it. Nintendo owns the likeness to Mario and using it in AI is still a violation of IP rights. You own the lyrics but not the resulting song. Making a video of gameplay mechanics is not a violation of a gameplay patent because no gameplay takes part. Copies of original works that are sufficiently similar to original works, even if deviations are present, are still treated as copyright violantions.

This is the worrying thing though. Theres a certain limit on how much a person can detect if its an AI slop or a real person's work, or just rely on their own instinct. Imagine needing alot of person to review a certain work just to check either its AI work or not.

>>737399612

>artists still wonder why they're hated and no one cares about ai making them homeless

Because it is easier to violate a copyright than to make something that satisfies the standards for copyrighted works.

also man, did you ever notice that 'satisfies' looks like a fake word
I swear I'm not even high, look at that bullshit
>>
So what is stopping me from
1. Drafting a dogshit design for my original character.

Lol.
>>

Nothing, actually. You can do that.
You still won't own copyright on that AI image, but that doesn't matter because no one else does either. You can totally use it ingame. If you want to steam, you just gotta declare AI usage.
>>
>>737400371
A more technical solution is needed, like an invisible watermark or a steganographic data within. Making it a guesswork based on the AI work itself seems impractical and can get worse over time as AI generation gets better.

There's more original concepts than you can generate
But technical challenge aside, I think you can argue that if you come up with a 'new' design and the only instance it existed in prior was AI, and you were not aware of that AI version, you still own copyright because AI doesn't.

The silver lining is that most people are too stupid to run local models, and the corpos are incentivized to add watermarks to avoid model collapse. So it might turn out not as bad as we fear.

>Why wouldn't it be?
Works without human authorship can't legally be copyrighted.
>The scenario of a bunch of people sitting around going "hmm, this ugly piece of shit would get a copyright if somebody drew it on his computer, but not if the computer drew it itself" sounds unreasonable.
That's completely reasonable. If a person draws something they can copyright it because they're a person. If a computer generated something then who's supposed to copyright it? The computer isn't responsible because it has no agency. The person/persons who prompted it didn't make it so it isn't theirs. The prompt itself can be generated by another machine so any human authorship of an AI-genned work means nothing. The training data uses to get the machine to be able to do that in the first place can't be attributed to any one artist/author/etc.
The reasonable solution is anything genned by AI should be public domain. If you can't attribute it to any one person then we can attribute it to everyone as a triumph of humanity itself.

If you draw the character then copyright it the new elements added are what you'll be copyrighting because we know the source is ai generated.

The AI core design dooms the original creation because the law (in theory) should require human authorship, so the original design is uncopyrightable.

All legal systems never accounted for ai creations in the creations of thier law and they're all either vague or specify copyrightable works need to be something made by a human author, the ones that exclude ai did it purely accidentally which is a kind of bullet we needed to dodge as a society desu

I can do it. some don't. I'm not helping.

That's because wojak and pepe are actual cancer that will refuse to die and got worse over time
>>
>>737409886
>lmao this would be nightmarish
It isn't, because it destroys the motive for copyright lawsuits. People will use AI for idea storming, then do their copyrighted designs based off it. Its no different than what we already do in the analog world.
>>
>>737397926
culture is supposed to change, yes
it's just proof how stagnated everything is now
everything is turning fetid instead of changing

A minor color edit doesn't erase copyright and doesn't count as an individual work and also isn't what anyone means by an AI-generated image, you dickless tittysucker.

It is. It's not regulated, and copyright only applies to human-made creations.
You can do whatever you want with AI-genned things and there's nothing anyone can do to you, period.
>>
>>737380293
Remember when AI jeets used to say that AI was going to free individuals from corporate control?
Look at us now, now they own everything because AI laundered individual ownership rights and nobody knows who owns what.
>>
>>737411267
>okay then what level does make it no longer copywritten
When it's AI-generated, you retard
>destroying copyright lawsuits
Who said anything about doing that? Sue, you'll lose. This shit can't be copyrighted.

NTA but land ownership(at least in the US) can get weird sometimes. Adverse possession law makes it possible to claim a property that isn't legally yours, by living on and openly(ie: not trying to hide what you're doing) developing that property without the owner's permission, if the owner's basically left it to rot and makes no effort to do anything with the property or kick you off of it. I think the period of time required varies by state though.
Conversely, taking care of your shit, keeping an eye on it, and demonstratively using it, strengthens your claim against little faggots trying to squat or steal it from you. Speaking from experience, if you own land and see some random surveyors show up on it unannounced/uninvited, get in touch with your lawyer and check things out quick, because someone's probably about to try to scam you out of it.

Factually correct. Shills will seethe below.

>>737397642
the prompter can have rights to specific commands he typed, he cannot legally own whatever AI spat out AND the fact that he used the prompt in llm in the first place, so legally owning right to it does nothing

That image is pretty shit. Smartphones making it easy is what enabled the right side to use it to begin with.
Everyone worried about AOL users being retarded when they first got funneled onto the net, but even the dumbest AOL user was still using a desktop and miles above the noise today.
