They absolutely can glass some human planet that isn't part of the Imperium. Obviously though somebody may not like it and try to fuck them over for it. In general Imperial politics, especially high level ones, are much more about what you can get away with than most are willing to admit But in this particular case it wasn't technically Exterminatus, the planet was fucked beyond saving anyway, you just accelerated what was happening and a Throne agent onboard gave you the greenlight anyway
