The relevant laws changed after the 3DS releases before that they ended up with the equivalent of a T rating, since then it became an adults rating. There was a whole big ordeal about them trying to rate Balatro adults only for the same reason.

Yeah, but they wouldn't. That's why they scrubbed it in HGSS and why the binned the trope entirely, including retconing it out of remakes after the fact. They didn't gimmick it out of the VC releases, why the fuck would they bother in a proposed Switch 2 collection (switch is dead to them)? Easier to just NOT sell a collection and have to jump hoops or sell it at Adults-only, when it's the same basic kid's game series it always was, but can't actually argue a balatro exception, as Tajiri went full 'tard and added proper fruit machine logic. There's a slew of emulators out there, go play them. You can even bullshit your save into a cart and actually bring it to proper games too. But Game Freak aren't going to offer you a chance to do that.

No, they released in in Europe and S. If they could have done that, RBYGSC wouldn't have been rated 12's kid. But in actuality, that would require digging into the old code, making the change, hoping they don't fuck the rest of the game, because it was a house of cards put together with spaghetti and master it, JUST to sell it in two regions. The new staff, anyone joining in Gen 3 or later would be worthless, as they wouldn't have been in the industry when Game Freak started writing what became Pokémon so that's dragging a senior head away from his day-to-day and hoping he knows how to massage the code to how you want it. I'm not the one asking for a collection of old games, because I wasn't alive to have played them in their era shitbag. Never mind CFW 3DS's to play "authentically" on a handheld (and there's buttloads of them around) so it's less like an emulator, if you need.
And I could care less your opinion on my vidya game taste, I'm at least an honest sort. If I'm interested in your game, I'll buy it. If I'm not, I'll ignore it entirely, including but not limited to "not seeking to pirate it to play it on unofficial hardware".

The problem is that with the region free nature of the Switch/2 they can't really just release or "enforce" a version of the game in any one region. EU law probably views the ability to purchase and use an outside region's version of a game as willing distribution which would get them in legal trouble. They would have to change how their entire digital distribution infrastructure works just for this one edge case.

It would be more realistic for them to either:

An underlying, re-occuring theme with the Pokemon games is to trade Pokemon with other people. This is why most mainline games have two versions with varying exclusives.

If you emulate, you're effectively missing out on a handful of Pokemon, and if you hack them in, then you might as well gen lvl 100 Pokemon with max stats and just steamroll the game.

Again, shit tastes, if simply because you don't respect or appreciate the game's underlying mechanics.

You can emulate trade, between your own save files or other people's from Gen 1 to 7. I think switch emulation even supports local multiplayer.

After Capcom released the Battle Network Collection and are going to be releasing Star Force, it shows they perfectly could rerelease the older games in a collection with the different versions

Battle Network allowed you to play the different versions of each game, them all having their own save files, and even allowing online play as well, they literally just have to copy what Capcom did for their collection
