Nintendo cheaped out and used ceramic instead of quartz for the audio chip's resonator (what controls the clock speed)
Ceramic resonators are cheaper but degrade over time, which causes the clock speed to actually increase

Yes. Generally all CPUs are able to run somewhat faster. The reason they limit them is to protect from overheating or other issues.
