On the one hand people have unceremoniously sold unreleased games as, and for the price of, generic prototypes because they couldn't be bothered to test or research, but on the other hand, the majority of the time prototypes tend to be final or practically final versions of random games. That said I would assume most prototype sellers who understand this and actually check their games before selling just sell it as a prototype and don't say anything about the contents if they know it's final.
