I think it depends which state you live in. I live in Texas and I dont think its even enforced. I think its just to make it easier for law enforcement to get a search warrant to find the real deal stuff.

For example I bought this manga, that has some questionable "loli" content in it. I had no clue until I read it.

After that, it depends on whether or not your state gives enough of a fuck to impose stricter or looser laws, and willing to spend taxpayer dollars going after jabronis for possession of lolicon.

i'd say always fight it, if it happens. the Miller test is an interesting one, i wonder how that would generally go. i feel like Mr and Mrs Average American wouldn't view lolicon as 'art' but wouldn't consider it horrifically offensive/harmful, either? icky and strange, at any rate.

maybe this was the guy i was thinking of. but i found a few others in random American newspapers. similar situations (always the wife wtf).

i have Saya no Uta on my computer right now. i consider that one artistic: it being uncomfortable is part of the experience. but i'm sure the right combination of police/judge/jury wouldn't see it that way, and they'd declare it porn.

Ashcroft v Free Speech Coalition rules that loli isn't CP and isn't inherently illegal but that some of it might break local obscenity laws

Stanley v Georgia says that mere private possession of obscene material is always fine, so any conviction for that would probably be thrown out on appeal

Obscenity laws vary by state, but they all have to abide by the Miller test, where anything with the slightest artistic or literary value is always legal no matter what, so loli/shota in something that has a plot should always be fine
