I think it depends which state you live in. I live in Texas and I dont think its even enforced. I think its just to make it easier for law enforcement to get a search warrant to find the real deal stuff.

If you're that worried, do not save anything like that to your computer, only view it online. If its online and not some secret club, anyone can access it site like twitter, rule34 sites or twitter, if you do get in trouble you can fall back on a "its right there, out in the open for anyone!" defense.
If you're looking at it through Sad Panda, not e-hentai.org, Sad Panda, or through some tor accessed website or anything else that requires "tricks" to view it, including foreign sites, then you're gonna be in hot water because not only was it not "publically" available, the fact that you "jumped through hoops" to access it really shows you're a pedo pervert.
