Realistically, Sasuke could have just went back to Konoha after killing Orochimaru (like he supposedly planned to do after beating Itachi), join up with team 7 again and have them help him out with getting to his brother. And it wouldn't even be that much of an issue with the higher ups since that's more or less what inoshikacho did with Hidan and Kakuzu. He really didn't need to go through with this Hebi shit.
