3 young 27 year old boys robbed a liquor store and the mentally retarded 35 year old behind the counter pulled his gun and got smoked.

Three entire people made the conscious decision to commit a very serious crime. You might decide that the triggerman deserves the worst punishment based on the circumstances, but it's possible (I would argue probable) his associates knew he was armed and they discussed the use of force beforehand. They're accessories to one of the worst crimes it's possible to commit. The cashier didn't instigate this sequence of events, and acted lawfully in response to a crime against property. They chose to shoot him, they forfeit their freedom. It's pretty open and shut anon.

You can't give them the same leniency you would a street fight. These are entirely different circumstances and the very fact of it being armed robbery demonstrates the most severe form of mens rea. There is not really a mitigating factor in this case, even if the store clerk drew first, which seems very unlikely, more likely they already had the gun out during the robbery and the clerk foolishly attempted to draw down on them and got murdered. The clerk making a stupid mistake does not make this self defense. The clerk had no guarantee of his life if he took no action. This is murder cut and dry.

No. The other two committed felony murder, and they get life as well as a minimum. This is a well established point of common law.

Not just talking out of my ass here, a cousin of mine recently got out of Angola prison after serving a 20 year sentence for felony murder. The guy that pulled the trigger got the electric chair. No it isn't. They made the decision to rob the store, they were the ones robbing the store, collectively they are all guilty of creating the chain of events that led to the clerk's death, and they collectively bear responsibility for it.
