watching the war over digital assets play out between the CFTC and SEC over the last few years has been interesting. seems like Treasury will be the one regulating stablecoins by delegating authority to banks or regulated financial institutions/money transmitters, CFTC working with utility tokens and governance tokens and whatnot, and SEC trying to define securities as broadly as possible
now they are going after "unregistered brokers" with binance, coinbase, kraken, uniswap and now metamask/swap
IMO hester pierce's safe harbor 2 regulatory sandbox is the most likely path forward (similar to the approach already deployed in Singapore, Hong Kong, UK and several EU jurisdictions)
