Overstock Short Sellers Lose Appeal Over Market Manipulation

Short sellers can’t continue to press their case that Overstock.com Inc. and its leaders forced them into a “squeeze” through improper tactics, the Tenth Circuit ruled Tuesday.

The suit stemmed from a bitter fight between Overstock’s leadership and investment funds betting on a loss in its share value. The short sellers, who say they were effectively forced to purchase shares in circumstances known as a short squeeze, sought to revive the case after the US District Court for the District of Utah dismissed it in 2021.

Back in 2008 the banking system blew up due to the housing crash (50% of all bank assets were tied to real estate). The problem they were having is the world was FLOODED with so much debt that there was zero capacity for anyone other than the Fed to step in as a buying to provide liquidity.
What the banks did was tell the banks to write a check and BUY $6TN worth of bonds and remove them from the market and deposit them at the Fed. The destroyed the Fed's balance sheet and in doing so they injected $6TN into the market by removing $6TN of illiquid marketable securities.
No one wanted MBS and they had no capacity to stuff them in to our insurance companies, pensions etc. So they wrote bogus checks to buy them out and locked them away. This is GARBAGE PAPER getting purchased as full price, prone to interest rate fluctuation, defaults, and an overpriced collateral. (bank loans are backstopped by collateral, and giving out credit on bad collateral is dangerous much like a credit card).
I would imagine there are looming problems here as the catalyst of 2008, the harbinger of financial calamity, once again rears its head.

The Overstock case doesnt matter and doesnt apply to Gamestop though. GME has only had about 25% of the free float DRS'd for over a year now, and reported short interest is way down. There's no way anyone could think a squeeze could happen, going off publicly available facts and information.
