bit of trivia for you: that solo was actually a composite that was cut and pasted together (on tape) by producer Quincy Jones from various parts of a recording that EVH made jamming over the track. You correctly picked up that the solo sound a bit out of place with the backing chords behind it. That's why.

Steve Lukather tells the story that EVH and his engineer accidentally ruined the master tape of Beat It that Quincy had sent them, so they had to remake the track keeping only MJ's vocal from the original. I've always felt that song sounds a bit stiff, rhythmically. This explains why. Recording a backing to an already recorded vocal would be way harder than recording a vocal to a backing.
