I just got pulled over for going 80 in a 60 in Virginia and the officer said that because I was going 20 over I have to go to traffic court with a reckless driving. What am I in for bros? Am I screwed? And what should I do?
Yeah, don't fucking speed in Virginia, they don't play with that shit.
>>27583040>Speeding in the most tyrannical state in the union, famous for their road pirate highwaymen

>>27583140It’s my first offense ever
>>27583040Yeah get a lawyer that’s shit is fucked t. Va anon
>>27583143get a traffic ticket lawyer. seriously. having traffic school is one thing, having a reckless on your record will jack up your insurance a metric shit ton.Keep in mind that ticket lawyers can't always get you off scot-free. you will still likely be on the hook for something on the ticket, but they can usually get it reduced and get certain charges dropped like the reckless. it's still worth it when you factor in the ticket lawyer and whatever you pay for the ticket in the end, it'll be cheaper than waiting for 3 years for it to disappear from your insurance record for your rates to normalize.
>>27583146Also does depend on the judge. I just got my first bike ticket for 12 over in Va, went to court and judge said maybe get your Speedo checked and said just don’t get another in 6 months and you are good to go. Ended up with just court costs of 60 dollars instead of a major fucking from insurance and such.
>>27583040Do what this anon said >>27583146 and lawyer up, or at the very least do a shit ton of research and try to get this reduced to a simple speeding ticket in courtreckless driving for going 20 over is complete bullshit, especially if you have a reasonable alibi such as >>27583068also according to virginia code you shouldn't have gotten the ticket in the first place
>>27583185Idk dawg going 20 over sounds pretty reckless to me, 26 over is an automatic suspension in a lot of places
>>27583040FAFO especially in Virginia
>>27583040are you a resident?not sure how its in your state, but in wi/il you go to court, and plead guilty.judge will usually issue you supervision, and sometimes a reduced fine.sometimes the cop wont show up, so its dismissed immediately.in most places, cops have a court day where they sit in court all day for their tickets. you can try rescheduling your court day last possible minute, half the time, the cop wont be available for the new date, and ticket will be dismissed.also is it really only 20 over for reckless driving in Virigina? how young are you? are you white? out of state?ive only been ticketed going 25 over, never required to attend court, each time i was actually going 30 over, but the cop saw that I was white, and didnt have to arrest or impound my car, and gave me a lower fine. one time the cop gave me a loud exhaust ticket because we went to the same high school.i drive past cops going 15-18 over all the time, they never go after me.
>>27583192The fact it was a temporary speed-up for an overtake seems like a good way to argue against the reckless charge imo.
>>27583197>sometimes the cop wont show up, so its dismissed immediately.Kek I got t-boned once when some guy ran a stop sign. He was charged with reckless and hired a lawyer for it. VA too. That motherfucker rescheduled twice, forcing me to come back to court each time, almost a year apart. The last time the officer didn't even remember me or the case. I jogged his memory and the guy and his lawyer ended up pleading guilty anyway.
>>27583194maybe you should leave on time so you aren't hurrying and can just crooooze>>27583199>already going 10 over (which is enough for a ticket) to overtake>proceeds to go another 10 over
>>27583185>also according to virginia code you shouldn't have gotten the ticket in the first placeThis is likely accurate, speeding tickets not specifically based on conditions have been found to be illegal revenue generation in more states than just mine.
I got a reckless in 2011ish, took it to court no lawyer and talked the judge down to paying the ticket and court fees but having it not on my record or reported to insurance. There's some word for this but I've forgotten. This was Flawduh tho, Virginia is the worst state for car stuff. Good luck, OP.
>>27583271Deferred adjudication is what they call it here in TX
>>27583040Lawyer. It'll hurt, but he'll probably keep reckless driving off your record which will save you money in the long run. And never speed in Virginia. I assume you're new to the area or were just passing through. We have the most militant anti-driver laws in the country. Worse than California. The cops will throw you in jail for speeding. It's not a meme.
>>27583197I’m a resident, I just moved here>>27583199Is it a mistake then that I didn’t tell the officer that? When he asked me if I had a reason to speed I just said no because I figured I’d just pay the ticket and move on from it, I’d never imagine going 20 over would automatically require traffic court. My parents just always told me to say you had no excuse and take responsibility

>>27583314I just want to let you know that saying "I was going 20mph over because I was overtaking" is literally admitting to going 20 over. That is a really dumb approach here.
>>27583314Well it sure sounds like you're taking responsibility so your parents will be proud at least. Seriously though I'm 95% sure that making an overtake is not considered an acceptable reason to exceed the speed limit anyway so it's not likely that it would've made a difference. You probably should've tried at least. Most cops don't actually want to ruin people's day and they'll look for an excuse to help you out if you give them one.
>>27583345cops that give out speeding tickets, on the other hand, deliberately go out of their way to ruin people's days

>>27583656https://www.greenspunlaw.com/faqs/reducing-a-reckless-driving-ticket-to-a-lesser-charge.cfmGetting it reduced to an improper driving sentence would be trivial if you got a lawyer, which just gets you a $500 fine and 3 points on your license for 3 years. A lawyer would also stand a very good chance of removing the points and ticket from your record given that you agree to take a driving safety courseIf you do it yourself, you might be able to get it reduced to improper driving but that'd be itIn addition, you could realize that Virginia is a shit state and move somewhere else
>>27583683Thank you, do you have any advice for how I can find a good local lawyer? Also I can’t move for a while, I’m living with my dad while I work to save up money for law school, though it sounds like I’m gonna lose a good chunk of the money I saved.

What if he pulled you over for speeding, but was interested in getting a DUI? Would he turn what would be a warning into a ticket, since you lied? You absolutely need to lawyer up for a reckless driving charge. If you don’t your premiums will literally triple.

>>27584169This happened to me. I was coming home from a concert, after midnight, got caught doing 80 in a 55. My own damn fault, I forgot where the speed trap was. He asked if I'd had anything to drink, I said truthfully that I'd had two beers about 4 hours prior. Had to do a sobriety test and breathalyzer, blew 0.0. He ended up knocking down the speed on the ticket by like 10 mph for being truthful. Bottom line, it worked out fine for me but I would absolutely take the other anon's advice in the future and say no if I know I'm 100% well under the limit.

Try to make it not reckless. negotiate with the prosecuter. It was clear day and you had perfect vision. Road was good. All others were going 70.you were in hurry to xx yyy but you still did not do 100.
back in the '80s during the age of 55 mph speed limits my mother used to deliver data tapes in the Philadelphia area. the highway she usually took to get to work in the morning had a notorious PHP officer in an unmarked car who would camp out by the side of the road and hunt down all speeders like the Terminator. they called him Old Brownie because of the color of his unmarked car.
>>27583040Going 20+ MPH over a posted limit / over 80 MPH in general is a misdemeanor offense in VA. Just take it on the chin and keep your car out of the “criminal record” zone in the future.
I have a similar issue (except that it's totally on me). Last year (17, just got my license) I was in the middle of breaking ties with my ex-gf. Was having a genuine meltdown in my car for some reason and started using my phone in traffic (a 17yo retard being retarded). Got caught by a female cop and I did everything wrong (emotionally distraught in a childlike way), now I've got court on may 9th that decides whether or not I keep my license. I'm totally retarded. Never got any other tickets before or after though, any way I can reduce the sentence a little?
>>27584532>You can be charged with DUI while under the limit if you fail to pass the field sobriety testsThat's why you never consent to field sobriety tests.
