it has to result in death. The last MLB player to die as a result of injury was Ray Chapman, who died as the result of being hit by pitch in the head. He never saw the pitch because it was a spitter and new balls were never put in play unless a foul ball or home run left the park, so the ball was probably filthy. After that, MLB required all batters to wear helmets and clean balls be put in play regularly, and it hasn't happened since.
