Furthermore, there are rules in place to discourage skaters from lifting their skates off the ice because it is well known to be dangerous (this is why scoring a goal with a kicking motion is not allowed). So it is well known lifting skates off the ice is dangerous. Copious expert testimony would establish ~it was not a valid play nor was it even remotely practiced in hockey at any level and that there was intent as it is impossible to do accidentally. This establishes the move as not a part of the game and a well known dangerous move and thus negligent homicide/depraved indifference/heartless whatever is a practical verdict.
