Yeah, they've got a different passport today, but five years ago they were the prospects you were trying to protect anyway. When the intent is to prevent teams from buying 19 year old Brazilians every window, telling a Dutch born, Dutch academy graduate that he has to leave his club to represent another country seems backward.
