I just read up on the case and he's suing openai for 2 core reasons; chatgpt is able to summarize his books to users which imply it was trained on his books without permission and chatgpt is able to produce fan fiction, the cited example in the lawsuit is “chatgpt produced a detailed outline for a sequel to A Clash of Kings that's different from A Storm of Swords”.

Legally I'm unclear if training on works is copyright infringement or fair use since from the best I understand it these model learn statistical relationships, not store & reproduce entire text like a sort of database which legally is not considered transformative.
