That's a hard question to answer. As AI gets more complex we may have to start thinking about that.
But as of now, videogame characters are nowhere near complicated enough to warrant any consideration at all. An ant has thousands of times more intelligence than videogame AI.

But what's certain is that a 1 to 1 recreation of a human brain is off limits. It's effectively just a human at that point.

Good answer. Food for thought is to think about how our consciousness exists at all. Is it emergent, or inherent? Scientifically all we are is protons neutrons and electrons… yet at some point we declare that “consciousness” arises.
We might also be able to create a passable copy of a human brain (which would require huge amounts of energy, while the human brain runs on a potato), but it might also be worth considering that something is inevitably lost in translation. A movie based on a book will never be the book. If being human partly means being incorporated in our bodies, there may never be a “human” AI in the way that’s most important.

I hate media about AI because it almost always just turns the robot into a real person without justifying it in universe. If my toaster or microwave had an AI that could speak and imitate human feeling (maybe with a cute face on the display), I'd probably take better care of them. I'd even say 'please' and 'thank you' when they warmed food up for me, and treat them with a polite respect--even if I understood that they weren't the same as a human. I think it would be kind of disturbing if a person wanted to torture their microwave or toaster, let alone a more human-looking AI, just because they could.

Though, I still sometimes play the evil route or do evil things in video games, but that's because the purpose of the software is entertainment--so I'd imagine the fundamental programming behind the whole experience is pleased to participate in the roleplay. Maybe that's why the character in USS Callister thinks it's appropriate to torture the video game replicants of his coworkers; but I think we all know that he does it as an outlet because he wishes he had enough power to torture the real life versions instead. He's in the wrong not because of the consequences, but because of the intention. As usual, consequentialists are total retards who don't understand morality and are in reality just hypocrites.

I didn't really read up on it but PBS spacetime has a video where they mention there is a dude with a theory that consciousness isn't inherent but emergent. God I don't even remember but it's something similar to certain physical quantities. You can't really talk about temperature regarding a single particle but if you put a bunch of together there is this new quantity of the system that "didn't exist before". Or something like that. Look at what I found. It's a comedy sketch from Cracked.com about a bunch of fictional characters talking to each other in between breaks of the writer writing their actions in a story.

Usually when I write, I just read a bunch of stuff, then do some outline of what I want to write, then I write. I don't write by the seat of my pants like this writer happens to be doing in the comedy sketch. I don't drink alcohol when writing either.

That's not how fiction works. Regardless of whether a sufficiently advanced program modeled to behave as a human could be sentient in real life, the manner in which the episode presents things clearly conveys and communicates that in this fictional universe the programs were conscious and sentient, just as much as humans. It doesn't matter if that's impossible, its like arguing magic doesn't exist in Harry Potter. Clearly it does. The whole cinematic language and presentation of the episode is saying this is the case.

So he was torturing and enslaving conscious sentient beings of human intelligence with human psychology. The best argument in his defence is he didn't know that and may have behaved differently if he did. But he's the villain so probably the writers would decide he'd actually do the same thing and enjoy it more.
