The real flaw in the logic is the rules regarding champions. Certain people have only certain people they can pick from, but only under certain circumstances, and in cases with people who are lower born or judged (by men, ironically) capable to fight, you may not be entitled to a champion at all.
There really should have been like a dedicated guild of religious warriors whose purpose, among general service, was to answer the call to fight in trials against each other.

Oh and don't forget that like 98% of the population don't even get trials. They get the ol' kangaroo court.

doesn't really make any sense if it's gonna be a fight to the death. any time somebody calls for trial by combat, that's one less member of the order. avoiding this by letting them yield would be dumb too, completely opens this shit up to corruption if you can pay off the opposing champion to take a dive.

the champion system works because the person has to be willing to actually die for you and the state is going to throw up their best warrior so it should usually be guaranteed death unless you've got plot armor like brom
