Kingpin getting out of jail scot-free is his superpower, he does it all the time in the comics. Even his S3 plan was kind of nonsensical, by the finale he was literally using the FBI to bodyguard and serve the food at his wedding, even though by that point he was technically free.

The other points can be easily explained, at this point in the MCU the government is taking strides to contain supers like with the DODC, assuming they don't just use them as soldiers like Val and the CIA (and it's established that Kingpin is working with her in the show). Jessica is in the show, Luke is acting as her house husband, and Iron Fist ended with him leaving NY to travel around the world. Spider-Man isn't there because he's in Sony jail.
