We know this because the story of Utnapishtim takes place an incredibly long time before Gilgamesh was alive. From the King List, you can get an idea of how much time they felt had passed since the flood to the point in which Gilgamesh (who was already a long since mythologized figure) had his story created. We can get a feeling that this happened thousands of years before the story was written down due to the king list, and the story itself wasn't preserved by Mesopotamians but Assyrians. That should give you some idea of just how fuckin' old this story is, and how long before the very concept of an ethnic Jewish/Israeli people were even a twinkle in someone's eye. They took it just like they took most of their laws from law codes that predate them.
