She then did not return the gun to a safe state and gave it to Baldwin, who rightly thought it was made safe for shooting. He was therefore not guilty of killing the other actor. Having said that, he was in charge of the film production. As captain of the ship, he is ultimately responsible for anything that happened under his watch, so this lawsuit is to claim civil damages against his company, with him as the figurehead. Most likely they will settle out of court and he will claim insurance money to pay it.

Regarding your very first sentence, no, CGI isn't required and standard practice is to aim too the side of a person and it's indistinguishable from aiming directly at them from the camera's perspective.

I have no idea the range involved in this scene. If it was close up and he knowingly detonated an explosive directed at a person, he's guilty of negligence at least. I'm not assuming that's the setup and I lost interest in the case so I'm not invested either way (I'm still a vindictive dickhead, I just don't care at all about this guy/case anymore, especially if the stakes are just monetary.)
