Because no one wanted to watch a sequel to Breaking Bad about (you)r dad being a mopey sad sack, but everyone wanted to see a show about Saul being a sleazy lawyer, and this possibility also included reintroducing Gus and Mike. It just made sense, and Odenkirk's desire to act his age was ignored because he'll play a lawyer in his very VERY late 30s and he'll like it, god damn it.

That's showbusiness baby, and personally I think they made the right choice.
