Soldiers are expected to give their lives when it comes to shove. If a group of soldiers are in enemy territory, and they're all wearing masks because they think the room might have toxic gas, the commanding officer may order one soldier to remove the mask and possibly die to confirm or disprove the fact that the air is toxic. That soldier can be legally commanded to die in order for the officer to gain information. So in that regard, Jack Nicholson's character is justified in using a soldier's life for the greater good.
