Thinking about it some more: Dunk is actually accused of two crimes:

Daereon accuses him of having kidnapped Egg. Dunk and, more importantly, Egg himself dispute this, so it's actually the word of two princes against each other. This is an unclear conflict of statments and can be decided by Trial by Combat, calling the gods to witness.

Then Dunk is also accused of having hurt Aerion. No one denies that he did it, but Dunk argues he had to do it because his knightly vow to obey the will of the gods compelled him to it. This is where it get's murky, but I guess the gods are called to state if this was truly their will.

But yeah, overall Gurm clearly hasn't put a lot of thought into the legal system of westeros. He's a shit worldbuilder after all.
