Cover Corp. reportedly had subcontractors (artists and editors) redo VTuber video productions at no charge with a total of 243 unpaid revisions.

The Japan Fair Trade Commission issued a warning on the 25th to Cover Corp on the Tokyo Stock Exchange Growth Market for violating subcontracting laws for VTuber video productions without payment. Cover manages Hololive Production, which includes the female VTuber group Hololive.

According to the JFTC, from April 2022 to February 2023, Cover Corp. has had 23 contractors, including freelancers, make 243 unpaid revisions on video projects, even though it was unclear if these corrections were necessary based on the original specifications.

In addition to the warning, the JFTC instructed Cover to prevent future issues after the company failed to pay about 1.15 million yen in overdue interest to 29 contractors due to payment delays caused by repeated video revisions.

Some of these delays lasted up to one year and seven months. Cover has since paid the fees, including interest.

A new law will go into effect in November, mandating that companies clarify work details when hiring freelancers.

Wrong again. The contractual obligation is paying the money you owe to a contractor for a Quid Pro Quou situation. Workers and contractors are not the same. Withholding payment ≠ wage theft. One is part of Civil law, on is part of criminal law, the concepts are very different. A party is legally allowed to withhold payment if the other party has also not fulfilled their contractual obligations. As Cover deemed that revisions were required, Cover is allowed to withhold payment to the other party as they dont consider the other party's contractual obligations to be fulfilled. Cover wants a correctly rigged product. If Cover then, after the other party fulfilled their obligations, does not hold up their contractual obligations it is a breach of contract and not a crime of wage theft. The other party can then claim damages but not pursue a criminal procedure. Learn legal language nijisis

The government definitely went after Cover to make this a precedent. It's harsher than other examples I know like the US FTC just sending warning letters to Sony, Microsoft and Nintendo over voiding warranties over just opening or not using a correct part on a part that isn't relevant to the warranty repair. But since this regards wages, they probably had to do that. And Cover admitted as much given they said themselves in the statement it failed to properly explain its demands in the original design orders, thus causing the need for multiple redos.
