Iirc some boards use a 2 lane config (or the TB controller gets switched to 2 lanes depending on other devices) which isn't compliant
TB certification is also heavily reliant on validation. Making aure daisy chaining works and all TB devices will just work.

The USB-IF stance is for hubs which is much easier to support as PCIe natively supports fanning out with PCIe switches
